Terms & Conditions
These Terms and Conditions of Use apply to all Gift Cards issued by Professionail & Spa Holdings Pty Ltd and all its Licensees after 01 March 2019.
You agree to these Terms when your purchase, activate, redeem, enquire, or attempt to use a Gift Card.
The Issuer may amend these Terms at any time without notice.
These Terms are governed by and construed in accordance with the laws and Courts of New South Wales.
Where you purchase these Gift Cards as a personal or business gift, or for other business uses approved by the Issuer, you must ensure that the end Gift Card holder is made aware of these Terms, including the expiry date.
Purchase of Gift Card
2.1 The Issuer only issues physical Gift Cards.
2.2 Gift Cards may be purchase from the Issuer (‘Professionail & Spa Holdings Pty Ltd’) and from any Licensee carrying on business at a Professionail store.
2.3 Enquiries relating to corporate orders, should contact the Issuer’s head office on (02) 9723 0644.
Redemption of Gift Card
3.1 A Gift Card has no value unless payment has been made to the Issuer.
3.2 A Gift Card may be redeemed for goods and services purchased from any Licensee carrying on business at a Professionail store, unless stated otherwise on the Gift Card.
3.3 On presentation of a Gift Card to a Licensee, the Issuer procures the Licensee to provide credit up to the balance of the Gift Card as stated on the Gift Card, against the purchase price due to the Licensee. If the purchase price exceeds the balance of the Gift Card, the gift card holder must pay the difference using another payment method. If there is a remaining balance, the Licensee is expected to retain the redeemed Gift Card and issue the Gift Card holder a Replacement Gift Card with the value of the remaining balance, with the same Expiry Date as the redeemed Gift Card.
4.1 A Gift Card expires 36 months from date of issue.
4.2 Any balance remaining on a Gift Card after the expiry date will not be able to be redeemed by the Gift Card holder.
5.1 A Gift Card presented in altered, fraudulent or defaced form will not be redeemed by the Gift Card holder.
5.2 A person may be asked to verify, to the reasonable satisfaction of the Licensee, that they are authorised to redeem a Gift Card issued by another Licensee.
5.3 A Gift Card cannot be redeemed for goods and services from Professionail stores operating outside Australia.
5.4 A Gift Card cannot be reloaded, used for cash advances, or redeemed for cash.
5.5 A Gift Card cannot be used to purchase other Gift Cards.
5.6 A Gift Card cannot be exchanged for a different brand, denomination, or type of Gift Card.
5.7 A Gift Card at all times, remains the property of the Issuer, and must not be resold or re-valued by a person, without the express written consent of the Issuer.
Lost and Stolen Gift Cards
6.1 A Gift Card must be treated as cash as it will not be reissued, refunded, or honoured if lost or stolen.
7.1 Gift Card holders are responsible for the use and safety of their Gift Card at all times.
7.2 To the extent permitted by law, Issuer, a Licensee, and their related entities are not liable to any person for any loss or damage (including direct or consequential loss), nor will they be in default of these Terms for failure to observe or perform any of their obligations under these Terms, for any reason or cause, which could not, with reasonable diligence, be controlled or prevented.
A Gift Card holder may be required to provide proof of identity.
Enquiries and Complaints
9.1 Where a person has a complaint or enquiry about Gift Cards, they should contact the Issuer at (02) 9723 0644.
9.2 Where a person has a complaint or enquiry about goods or services purchased by a person using a Gift Card, they should contact the relevant Licensee where they purchased the goods or services.
Information we collect and how it is used
ProfessioNAIL only gathers personal information, such as, first and last names, addresses, telephone numbers and email addresses, when voluntarily submitted by you. When a gift voucher is purchased through this website or through marketing / promotional activities (e.g.: via this website, in a store operated by us, over the telephone etc.), personal information may be requested (such as name, phone, email and address) in order to provide the gift voucher, product information, information in respect of the salons operated under the ProfessioNAIL name, marketing materials, provide newsletters, electronic newsletters (e-newsletters), provide new release / launch information, and advise of other ProfessioNAIL products, competitions or events, which may be of interest. No one is obligated to provide personal information. However, failure to do so may result in ProfessioNAIL being unable to provide you with the product you require or future promotion, event, or product information and/or provide after sales services.
In common with many commercial websites, we may also collect information which tells us about visitors to our website. For example, we may collect information about the date, time and duration of visits and which pages of the website are most commonly accessed. This information is generally not linked to the identity of visitors, except where the website is accessed via links in an email we have sent.
Sharing of personal information
Companies may be engaged by ProfessioNAIL to perform a variety of functions, such as, fulfilling orders, assisting with promotions, providing technical services for our web sites, etc. These companies may have access to personal information if needed to perform such functions. However, these companies may only use such personal information for the purpose of performing that function and may not use it for any other purpose.
ProfessioNAIL does not sell personal information to third parties. However, with your permission, we will, on occasion send marketing information on behalf of one or more of our Licensees or our business partners about products or services they provide that may be of interest to you. You may be asked if you wish to receive marketing materials from ProfessioNAIL, our Licensees and or business partners. If you elect to receive such materials, ProfessioNAIL will not share your personal information with our Licensees or partners but rather will send a mailing or e-mail on behalf of our Licensees or partners.
ProfessioNAIL reserves the right to use or disclose any information as needed to satisfy any law, regulation or legal request, to protect the integrity of the website, to fulfil your requests, or to cooperate in any law enforcement investigation or an investigation on a matter of public safety.
ProfessioNAIL is very sensitive to privacy issues. We are proud of our long-time commitment to our customers. We are especially careful in any communications with persons under 18 years of age.
It is our policy not to promote our products and services to persons under 18 years of age. We may on occasions were appropriate promote appropriate services to persons over 16 years of age. For example, we may promote nails art services to those persons participating in final year formals or graduation balls who are young adults and who will soon be18 years of age.
Will not knowingly collect or store any personal information from minors or in respect of minors. We may collect a name and a telephone number from minor if they request a product or service from one of our salons for the purposes only of providing that product or service.
Security of personal information
ProfessioNAIL will endeavour to take all reasonable steps to keep secure any personal information recorded, and to keep this information accurate and up to date. The information is stored on secure servers that are protected in controlled facilities. Access is restricted to those involved in administration or fulfilment of the product or service requested for which you have provided your personal information.
You are in control of any personal information you provide to us. If at any time, you would like to correct the personal information we have about you or if you would like to change your preferences for contacts from us or on behalf of our Licensees or business partners, you can let us know by contacting us at the email or postal address listed below. Your personal information may be stored in different locations depending upon the reason for which you originally submitted the information. The more information you can provide us about when you originally submitted your personal information, the quicker ProfessioNAIL will be able to retrieve your personal information.
In order to review any personal information, we have about you or to ask us to delete that information or to stop further use of the information, please submit this information request form. Please allow 14 days for this request to be processed.
The purpose of this policy is to advise you as our customer, as to the services that can be expected from ProfessioNAIL, and the steps and procedure that can be taken if you, the customer are not satisfied with the services you receive from ProfessioNAIL.
Please be advised that ProfessioNAIL is a chain of independent operators, in that, each salon is operated by individual owners under the terms of license and may be subjected to their own policies – please ask for more details in store.

What you need to do
At ProfessioNAIL, we strive our best to provide high quality service and we treat you with courtesy and respect.
To allow us to provide a quality service as efficiently as possible, you need to:
Ask for the service which you would like to have. If you are unsure, please speak to the salon manager.
Inform our staff if you are allergic to any chemicals or substances or any other medical conditions, we should be made aware of, before the receiving any service.
Whilst receiving any service please provide our staff with your feedback and or comments during your services so our staff can satisfy your requirements straight away.
Inform the staff member or salon manager immediately if you have any concern relating to the salon, the staff, or any service.
Inform the salon manager immediately if you have any concern that you have any infection or any other abnormal reaction or condition with respect to your nails.
Prices of services, products, and other charges will vary depending on the store and its operator (Licensee). Please ask in store for more details.
Our Licensees reserve the right to change their prices without prior notice – this can be due to several factors such as increase in expenses or higher demand.
All prices are inclusive of GST.
Refunds, Returns, and Exchanges
Due to the services rendered, ProfessioNAIL have a strict ‘REFUND and EXCHANGE’ policy.
No refunds or credit notes will be given if you have simply changed your mind’.
Your satisfaction is our highest priority. If you are not completely contented, please let us know during your treatment or within 24 hours after your service has been performed. We are committed, within reasonable expectations, to making any needed corrections at no cost if our store if found accountable. However, please note that once you have left our store, we will deem it as we have completed your service(s) to your satisfaction.
If there are issues on your nail’s longevity(i.e., chipped, fading of colour), please return to the store within 7 days of your initial service for further assessment. If found at fault, the store can offer a free touch-up on the affected nails. However, for lacquer (or normal polish) this period is only for 2 days of your initial service. Outside these periods, there will be a small fee charged – please refer to the store’s price list.
Please refrain from personally removing or re-shaping your nails before returning to the salon. Any removal or alteration before contacting the salon will abstain the Licensee from further liability whether personally or from another salon.
Our Licensees are not responsible for the cost of any repairs or replacements that they have to carry out because of damage you have caused.
For example, due to your own lack of care, your nails are damaged – in that they are broken, chipped, or starting to lift.
Infills for nails are recommended every 2-3 weeks depending on the type of application. However, infills over the prescribed maximum 2-3 weeks will be charged an extra fee.
If you have any complaints or feedback, please contact the store manager of the salon you received the service at. As each store is independently owned, your issue can not be redirected to or resolved at another location.

If possible, please provide us a copy of the service receipt for payment of visit.
